Since 1 January 2023, an entirely new code governs contracts in Belgium. The rules of the game have changed — even for agreements you entered before that date. Concepts such as e.g. actio timoris and wrongful negotiating are new. Anyone entering into a contract today without knowing these new rules runs risks that did not exist before.

Also when negotiations go wrong: anyone who abruptly walks away from an ongoing negotiation process can today be held liable for the damage this causes the other party. That used to be different.
