LIABILITY LAW

Damage & Liability

When something goes wrong, it must be clear who pays the price.

A traffic accident. A medical error. A contractor who fails to carry out their work properly. A product that causes damage. A fall in a shop or public space. In all these situations the same question arises: who is liable, and for how much? Answering that question requires legal analysis, but also an understanding of how insurers operate — and how they try to minimize damages.

For traffic accidents abroad, we can rely on our international networks of lawyers, which allow us to engage a good lawyer in that country almost instantly.

We help victims fully map out their damage: physical, material and moral damage, loss of income, costs of adapting the home, loss of enjoyment of life. Many victims accept an insurer’s first offer without realizing how far below the actual damage that offer lies.

But anyone wrongly held liable — by a neighbor, a customer or a public authority — can also turn to us for their defense. Liability is not automatic. We test every file against the facts and the law.

Belgium also has a new Code of Non-Contractual Liability, which entered into force on 1 January 2025. It contains a number of innovations you may not be aware of, which can prove decisive in your case.
